NSSF Objects to U.S. Government Abandoning Position that U.N. Treaty Must be based on International "Consensus"

NEWTOWN, Conn. -- The National Shooting Sports Foundation today strongly objected to the last-minute reversal of the U.S. government position regarding the United Nations Arms Trade Treaty. In the closing hours of negotiations on Thursday, March 28, the government abandoned its previous insistence that the treaty be approved only through achieving “consensus” of all the member states. Requiring consensus had been the United States position going back to earlier administrations.

At the end of the session, a U.S. government spokesperson told reporters “It's important to the United States and the defense of our interests to insist on consensus. But every state in this process has always been conscious of the fact that if consensus is not reached in this process, that there are other ways to adopt this treaty, including via a vote of the General Assembly.” The spokesperson went on to say that the United States would vote “yes” on the treaty in the General Assembly, regardless of the positions of other member states. By abandoning the requirement for consensus the United States is assuring passage of the treaty by the United Nations.

“This abrupt about-face on the long-standing United States requirement for ‘consensus’ illustrates that the Obama Administration wants a sweeping U.N. arms control treaty,” said Lawrence Keane, NSSF senior vice president and general counsel. “We are troubled by the timing of the Obama Administration’s decision to abandon consensus on the eve of the Senate debate on pending gun control measures. The United Nations treaty would have a broad impact on the U.S. firearms industry and its base of consumers in the U.S.”

Industry analysts have identified three major areas of concern with the treaty text. The treaty clearly covers trade in civilian firearms, not just military arms and equipment. It will have a major impact on the importation of firearms to the United States, which is a substantial source for the consumer market. And it will impose new regulations on the “transit” of firearms, the term defined so broadly that it would cover all everything from container ships stopping at ports to individuals who are traveling internationally with a single firearm for hunting or other sporting purposes.

“We hope that the Members of the U.S. Senate are closely watching the White House abandon its principles and promises in the rush to ramrod this flawed treaty into effect. Not only will they later be asked to ratify this attack on our constitution and sovereignty, but they will also be lavished with new promises from the administration in its drive to push a broad gun control agenda through the U.S. Senate when it returns from recess. They would be right to question those promises strongly,” concluded Keane.

Make Your Voice Heard Through NSSF Legislative Action Center

Through its online Legislative Action Center, the National Shooting Sports Foundation offers a convenient way for supporters of the Second Amendment to urge their legislators to oppose severely restrictive firearms bills that have been introduced in the U.S. Congress and in many states.

NSSF's Legislative Action Center is the industry's one-stop hub for finding contact information for federal and state legislators, learning about newly introduced firearms legislation and taking action--sending a letter or making a phone call to lawmakers. Visitors can use both the Research State and Federal Legislation and Industry-Relevant Federal Legislation tools for tracking alarming efforts to restrict ownership and use of semiautomatic rifles and ammunition.

Restrictive gun-control legislation has been introduced throughout the country, including in the U.S. Congress and in California, Colorado, Connecticut, Maryland, Minnesota and New Jersey. Other states are expected to follow suit. New York has already hastily passed new anti-gun laws, the severe impacts of which are only just being realized. In response, firearms owners are turning out by the thousands at state hearings, but just as important is letting legislators know by letter or phone call that these proposed bills are misguided, unwarranted and an assault on Second Amendment rights.

NSSF's Legislative Action Center provides a core letter, which can be expanded and personalized, that urges legislators to not waste time and public resources on reinstating failed gun-control measures, such as the so-called "assault weapons ban." For a decade, the ban restricted the sale of semiautomatic rifles and limited magazine capacity to 10 rounds, but according to a U.S. Department of Justice study, the ban did not reduce crime. And since the ban expired in 2004, violent crime has declined.

Legislators are urged to focus instead on effective solutions that will reduce the criminal misuse of firearms by enforcing existing gun laws, improving the background check database and preventing access to firearms by unauthorized persons, including children, at-risk individuals and prohibited persons.

Use the NSSF Legislative Action Center to call or write your federal and state legislators today and urge them to protect your right to own and use the firearms of your choice for target shooting, hunting, personal and home protection and collecting.

December 2012 NSSF-Adjusted NICS Background Checks Up 58.6%

The December 2012 NSSF-adjusted National Instant Criminal Background Check System (NICS) figure of 2,237,731 is an increase of 58.6 percent over the NSSF-adjusted NICS figure of 1,410,937 in December 2011. For comparison, the unadjusted December 2012 NICS figure of 2,776,105 reflects a 49.7 percent increase from the unadjusted NICS figure of 1,854,400 in December 2011.

This marks the 31st straight month that NSSF-adjusted NICS figures have increased when compared to the same period the previous year. The number reported for December 2012 is the highest monthly figure ever reported for NICS, eclipsing the previous high in November 2012 by 46.7 percent.

The NSSF-adjusted NICS 2012 year-end figure of 13,780,285 was a 27.7 percent increase over the 2011 year-end total of 10,791,275. For comparison, the unadjusted NICS year-end figure of 19,436,832 in 2012 was an increase of 19.0 percent over the 2011 year-end total of 16,336,732.

The adjusted NICS data were derived by subtracting out NICS purpose code permit checks used by several states such as Kentucky, Iowa and Michigan for CCW permit application checks as well as checks on active CCW permit databases.

Though not a direct correlation to firearms sales, the NSSF-adjusted NICS data provide a more accurate picture of current market conditions. In addition to other purposes, NICS is used to check transactions of firearms sales and transfers on new and used handguns and long guns.

For additional information on NICS or to view a complete set of the current monthly reports, please visit the NICS website.
